THE NATIONAL INSPECTION AUTHORITIES, MEMBERS OF THE NETWORK OF THE EUROPEAN JUDICIAL INSPECTION SERVICES<\/strong><\/p><p style=\"text-align: center;\">(adopted at the General Meeting of RESIJ on 25.06.2021 \u0433.)<\/p><p style=\"text-align: center;\"><strong>PREAMBULE<\/strong><\/p><p style=\"text-align: justify;\">WE, the members of the Network of European Judicial Inspection Services (RESIJ),<\/p><p style=\"text-align: justify;\">Guided by the idea of working together to achieve the common objectives of judicial inspections set out in the founding documents of the Network,<\/p><p style=\"text-align: justify;\">Recognizing our primary mission to help build an even better, independent and fair judiciary,<\/p><p style=\"text-align: justify;\">Emphasizing the need to adopt common guiding ethical principles and rules to promote the independence of judicial inspections and to help increase their effectiveness and public confidence,<\/p><p style=\"text-align: justify;\">Noting that the ethical performance of duties in carrying out inspection activities ensures its objectivity and impartiality,<\/p><p style=\"text-align: justify;\">Taking into account the diversity of legal regulations and national traditions regarding the place of judicial inspections and using this diversity to define our ethical principles and rules,<\/p><p style=\"text-align: justify;\">We adopt this European Charter of Professional Ethics for national inspection bodies, members of the Network of European Judicial Inspection Services.<\/p><p style=\"text-align: center;\"><strong>CHAPTER ONE BASIC PRINCIPLES <\/strong><\/p><ol style=\"text-align: justify;\"><li><strong> Independence <\/strong><\/li><\/ol><p style=\"text-align: justify;\">1 Independence is a right and obligation of the inspection body and means that while performing its du ties, it is subject to the statute and the law.<\/p><p style=\"text-align: justify;\">Independence requires ignoring any attempts to influence the inspections being carried out, regardless of their origin: especially by administrative, political, trade union bodies or pressure groups.<\/p><p style=\"text-align: justify;\">It is inadmissible to exercise undue influence in carrying out inspections or any other influence on the part of the professional community.<\/p><p style=\"text-align: justify;\">In exercising their independence, inspectors must act professionally and responsibly. In doing so, they must respect the independence of judges and prosecutors in the exercise of their judicial functions in all phases of the judicial process. Under no circumstances may the inspector rule on the merits of the judgments.<\/p><ol style=\"text-align: justify;\" start=\"2\"><li><strong> Impartiality<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/strong><\/li><\/ol><p style=\"text-align: justify;\">Impartiality guarantees the absence of prejudice on the part of the inspection body and its members. It is manifested in the way of work and the conclusions made, as well as in the behavior of the inspectors towards the inspected body and the particular inspected person.<\/p><p style=\"text-align: justify;\">Impartiality requires the observance of two basic principles, ensuring equal treatment and avoiding conflicts of interest while carrying out the inspections.<\/p><p style=\"text-align: justify;\">Ensuring equal treatment means:<\/p><p style=\"text-align: justify;\">&#8211; to not allow preferences, bias or prejudice based on race, origin, ethnicity, sexual orientation, gender, religion, education, beliefs, political affiliation, personal and social status or property status;<\/p><p style=\"text-align: justify;\">&#8211; to apply the same standards to all inspected persons;<\/p><p style=\"text-align: justify;\">&#8211; to respect and ensure the right of the inspected persons to express opinions and make objections in the course of the inspection;<\/p><p style=\"text-align: justify;\">&#8211; to not make public statements or comments on pending inspections that may raise the impression of bias.<\/p><p style=\"text-align: justify;\">Avoiding conflicts of interest means ignoring situations in which there may be a suspicion of a direct or indirect personal or other significant interest for the inspecting inspector that could affect the objectivity and impartiality of the inspection, or cast doubt for such influence.<\/p><p style=\"text-align: justify;\">The specific hypotheses of conflict of interest are formulated in the national law of each of the Member States of the Network and this Charter only pays attention to their relevance.<\/p><p style=\"text-align: justify;\">In the event of a conflict of interest, the inspectors must be removed.<\/p><p style=\"text-align: justify;\">In the event of a suspicion of a conflict of interest, inspectors may request advice from the management of the service or from another deontological body if national law so provides. Confidentiality must be guaranteed during the consultation.<\/p><p style=\"text-align: justify;\">Impartiality is a key factor in building and upholding the authority and trust of the inspection service and should be a priority for its management.<\/p><ol style=\"text-align: justify;\" start=\"3\"><li><strong> Integrity <\/strong><\/li><\/ol><p style=\"text-align: justify;\">Integrity meets the general requirement of honesty. It is a key element of the conduct required in carrying out inspection missions, in the office and in society. Integrity has many forms, all of which are related to the concepts of honesty and dignity of the individual. The inspectors must:<\/p><p style=\"text-align: justify;\">&#8211; to be honest and open in their behavior;<\/p><p style=\"text-align: justify;\">&#8211; not take advantage of their official position to benefit;<\/p><p style=\"text-align: justify;\">&#8211; not to solicit or allow the soliciting in favor of an inspected person;<\/p><p style=\"text-align: justify;\">&#8211; not to perform actions that are contrary to the understandings of decency established in society;<\/p><p style=\"text-align: justify;\">&#8211; not to perform actions related to their functions or beyond, which damage the prestige of the judicial inspection service.<\/p><p style=\"text-align: justify;\">In determining the characteristics of the required fair conduct, inspectors may request deontological consultations with the management of the service or other deontological authorities if national law so provides. The confidentiality of such consultations must be guaranteed.<\/p><ol style=\"text-align: justify;\" start=\"4\"><li><strong> Confidentiality and professional discretion <\/strong><\/li><\/ol><p style=\"text-align: justify;\">The members of the judicial inspection services must carry out their duties with the utmost discretion as to the facts and information which became known to them during or in connection with the performance of their duties.<\/p><p style=\"text-align: justify;\">They may not misuse (outside of the nature of the verification) the information which became known to them in the performance of their functions.<\/p><p style=\"text-align: justify;\">Members of the judicial inspection services may not disclose information about the personal life or protected personal data of the inspected persons or those that harm their protected interests or their reputation.<\/p><p style=\"text-align: justify;\">Inspectors must respect the confidentiality of their professional activities when required by law.<\/p><ol style=\"text-align: justify;\" start=\"5\"><li><strong> Fairness <\/strong><\/li><\/ol><p style=\"text-align: justify;\">Justice is an ethical attitude towards the objective establishment of facts and their interpretation. The implementation of the principle of fairness is related to the following requirements:<\/p><p style=\"text-align: justify;\">&#8211; during the conducted inspections, to collect, check and analyze all relevant facts of the subject of the inspection;<\/p><p style=\"text-align: justify;\">&#8211; when issuing the conclusions (acts) of the inspections, to pay special attention to issues that could unduly restrict or affect the freedom and\/ or reputation, both of the inspected persons and possibly of third parties directly or indirectly affected by the inspection;<\/p><p style=\"text-align: justify;\">&#8211; the inspectors are guided by the requirement of fairness in cases where the law provides them the opportunity to decide certain issues upon their discretion.<\/p><ol style=\"text-align: justify;\" start=\"6\"><li><strong> Loyalty <\/strong><\/li><\/ol><p style=\"text-align: justify;\">Loyalty originates from the duty of integrity that inspectors must comply with. It is the result of the transparency and predictability of their actions and includes the obligation to report on their activities. It shall apply to the contracting authority, the members of the mission teams and the inspection service. Loyalty requires adherence to the guiding principles for conducting missions.<\/p><p style=\"text-align: justify;\">Actually, loyalty in the judicial inspection manifests itself in several ways: &#8211; loyalty in carrying out inspections;<\/p><p style=\"text-align: justify;\">&#8211; loyalty, expressed in the bona fide performance of missions assigned by the contracting authority;<\/p><p style=\"text-align: justify;\">&#8211; loyalty to the contracting authority;<\/p><p style=\"text-align: justify;\">&#8211; in carrying out inspections by the inspection service in a team, loyalty is manifested through the exchange of information and compliance with the established methodology;<\/p><p style=\"text-align: justify;\">&#8211; loyalty in an interinstitutional aspect, when inspection services carry out joint activities with other bodies and services, which is manifested in transparency of the manner of action, bona fide and well-intentioned activities towards these bodies or services.<\/p><ol style=\"text-align: justify;\" start=\"7\"><li><strong> Modesty and courtesy <\/strong><\/li><\/ol><p style=\"text-align: justify;\">During inspections, inspectors must show respect, attention, tolerance and consideration with regard to all inspected bodies and their members.<\/p><p style=\"text-align: justify;\">Modesty and courtesy shall also be manifested towards all persons who are questioned or are a source of other information during inspections.<\/p><ol style=\"text-align: justify;\" start=\"8\"><li><strong> Competence and qualification <\/strong><\/li><\/ol><p style=\"text-align: justify;\">The requirement for competence and professional development is essential for achieving quality, speed and efficiency of the performed inspections.<\/p><p style=\"text-align: justify;\">High qualification and competence contributing to the implementation of the requirements of independence, impartiality and integrity of inspectors.<\/p><p style=\"text-align: justify;\">The establishment of mechanisms for verification of competence and creation of conditions for continuous professional development is the main concern of the inspection services.<\/p><p style=\"text-align: justify;\">Professional development is encouraged by the Network of European Judicial Inspection Services through appropriate initiatives and exchange of experience.<\/p><ol style=\"text-align: justify;\" start=\"9\"><li><strong> Transparency of inspections <\/strong><\/li><\/ol><p style=\"text-align: justify;\">Transparency is an important factor for public awareness and for multiplying the effect of the results of the work of inspection services. It contributes to prevention.<\/p><p style=\"text-align: justify;\">The inspection services shall provide the public with timely, comprehensible and objective information on the inspections carried out. The information provided to the public by the inspection services must be through mechanisms established in national law.<\/p><p style=\"text-align: justify;\">The information provided must comply with the requirements of confidentiality and professional discretion laid down in national law and in this Charter.<\/p><p style=\"text-align: justify;\">On the basis of the information provided, judicial inspections may identify lawful and unlawful conduct under national law.<\/p><p style=\"text-align: justify;\">The information provided may constitute the basis and reason for discussions on ethical topics, and for this purpose the specific cases must be duly anonymized.<\/p><p style=\"text-align: center;\"><strong>CHAPTER TWO <\/strong><\/p><p style=\"text-align: center;\"><strong>MONITORING AND CONTROL MECHANISM <\/strong><\/p><p style=\"text-align: justify;\">The principles set out in this Charter serve as guidelines for the basic ethical standards required of heads of judicial inspections and inspectors in the performance of their duties. They have advisory nature and aim to assist the heads of judicial inspections and inspectors with regard to the ethical and professional issues they face.<\/p><p style=\"text-align: justify;\">The Charter shall be published on the website of the Network of European Judicial Inspection Services, as well as on the website of each inspection service &#8211; member of the Network of European Judicial Inspection Services.<\/p><p style=\"text-align: justify;\">The authorities and the bodies entrusted under national law with the function of inspection services shall ensure that the rules and principles of this Charter are complied with and applied.<\/p><p style=\"text-align: center;\"><strong>ADDITIONAL PROVISION <\/strong><\/p><p style=\"text-align: justify;\">In the member states of the Network, where there is no legally provided inspection body, with independent legal personality, separately or within a supreme body of the judiciary (SJC, Minister of Justice), the principles and rules of this Charter apply only if they are compatible with the framework of national legislation. Whether there is such compliance or not, the highest judicial authority in the particular country shall rule on that.<\/p><hr \/><p style=\"text-align: justify;\"><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> The principle of impartiality is formulated in the languages of the members of the Network, in accordance with the provisions of national law.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"has_eae_slider elementor-column elementor-col-33 elementor-top-column elementor-element elementor-element-ab657e9\" data-eae-slider=\"50440\" data-id=\"ab657e9\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap\">\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"has_eae_slider elementor-column elementor-col-33 elementor-top-column elementor-element elementor-element-c00e441\" data-eae-slider=\"44818\" data-id=\"c00e441\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-e942350 elementor-widget elementor-widget-text-editor\" data-id=\"e942350\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p style=\"text-align: center;\"><strong>CHARTE EUROP\u00c9ENNE<\/strong><\/p><p style=\"text-align: center;\"><strong>SUR LA D\u00c9ONTOLOGIE DES AUTORIT\u00c9S NATIONALES D&#8217;INSPECTION, MEMBRES DU R\u00c9SEAU EUROP\u00c9EN DES SERVICES D&#8217;INSPECTION DE LA JUSTICE<\/strong><\/p><p style=\"text-align: center;\">(adopt\u00e9e \u00e0 l&#8217;Assembl\u00e9e G\u00e9n\u00e9rale du RESIJ le 25.06.2021)<\/p><p style=\"text-align: center;\"><strong>PR\u00c9AMBULE<\/strong><\/p><p style=\"text-align: justify;\">Nous, les membres du R\u00e9seau Europ\u00e9en des Services d\u2019Inspection de la Justice (RESIJ),<\/p><p style=\"text-align: justify;\">Guid\u00e9s par l\u2019id\u00e9e d\u2019\u0153uvrer ensemble pour atteindre les objectifs communs des inspections de la justice, tels qu\u2019ils sont \u00e9nonc\u00e9s dans les textes fondateurs du R\u00e9seau,<\/p><p style=\"text-align: justify;\">Conscients de notre mission principale de contribuer \u00e0 la mise en place d\u2019un syst\u00e8me judiciaire encore meilleur, ind\u00e9pendant et \u00e9quitable,<\/p><p style=\"text-align: justify;\">Soulignant la n\u00e9cessit\u00e9 d\u2019adopter des r\u00e8gles et des principes \u00e9thiques communs qui favorisent l\u2019ind\u00e9pendance des inspections de la justice et contribuent \u00e0 renforcer leur efficacit\u00e9 et la confiance du public,<\/p><p style=\"text-align: justify;\">Notant que l\u2019accomplissement \u00e9thique des obligations dans le cadre de l\u2019exercice de l\u2019activit\u00e9 d\u2019inspection garantit son objectivit\u00e9 et son impartialit\u00e9,<\/p><p style=\"text-align: justify;\">Tenant compte de la diversit\u00e9 des cadres juridiques et des traditions nationales en ce qui concerne la place des inspections de la justice et en tirant parti de cette diversit\u00e9 pour d\u00e9finir nos principes et r\u00e8gles \u00e9thiques,<\/p><p style=\"text-align: justify;\">Nous adoptons la pr\u00e9sente Charte europ\u00e9enne de d\u00e9ontologie des services d\u2019inspection nationaux, membres du R\u00e9seau europ\u00e9en des services d\u2019inspection de la justice.<\/p><p style=\"text-align: center;\"><strong>CHAPITRE PREMIER PRINCIPES FONDAMENTAUX <\/strong><\/p><ol style=\"text-align: justify;\"><li><strong>Ind\u00e9pendance <\/strong><\/li><\/ol><p style=\"text-align: justify;\">L\u2019ind\u00e9pendance est le droit et le devoir de l\u2019autorit\u00e9 charg\u00e9e de l\u2019inspection et signifie que, dans l\u2019exercice de ses fonctions, elle est soumise \u00e0 la loi et au droit.<\/p><p style=\"text-align: justify;\">L\u2019ind\u00e9pendance implique de ne pas tenir compte de toute tentative d\u2019influencer les inspections effectu\u00e9es de quelle qu\u2019origine qu\u2019elle soit: autorit\u00e9s administratives, politiques, syndicales ou groupes de pression notamment.<\/p><p style=\"text-align: justify;\">L\u2019exercice d\u2019une influence indue dans la conduite des inspections ou tout autre impact de la part de la communaut\u00e9 professionnelle est inacceptable.<\/p><p style=\"text-align: justify;\">Dans l\u2019exercice de leur ind\u00e9pendance, les inspecteurs doivent agir de mani\u00e8re professionnelle et responsable. Ce faisant, ils doivent respecter l\u2019ind\u00e9pendance des juges et des procureurs dans l\u2019exercice de leurs fonctions judiciaires \u00e0 toutes les phases de la proc\u00e9dure judiciaire. En aucun cas, l\u2019inspecteur ne peut se prononcer sur le fond des d\u00e9cisions de justice.<\/p><ol style=\"text-align: justify;\" start=\"2\"><li><strong>Impartialit\u00e9<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> <\/strong><\/li><\/ol><p style=\"text-align: justify;\">L\u2019impartialit\u00e9 garantit l\u2019absence de pr\u00e9jug\u00e9 de l\u2019autorit\u00e9 charg\u00e9e de l\u2019inspection et de ses membres. Elle transpara\u00eet dans les modalit\u00e9s de travail et les conclusions \u00e9tablies ainsi que dans le comportement des inspecteurs \u00e0 l\u2019\u00e9gard du service d\u2019inspection ou de la personne sp\u00e9cifiquement inspect\u00e9e.<\/p><p style=\"text-align: justify;\">L\u2019impartialit\u00e9 exige le respect de deux principes fondamentaux: garantir l\u2019\u00e9galit\u00e9 de traitement et \u00e9viter les conflits d\u2019int\u00e9r\u00eats lors des inspections.<\/p><p style=\"text-align: justify;\">Garantir l\u2019\u00e9galit\u00e9 de traitement signifie:<\/p><p style=\"text-align: justify;\">\u2014 \u00c9viter les pr\u00e9f\u00e9rences, pr\u00e9jug\u00e9s ou partis pris fond\u00e9s sur la race, l\u2019origine, l\u2019appartenance ethnique, le genre, l\u2019orientation sexuelle, le sexe, la 3 religion, l\u2019\u00e9ducation, les convictions, l\u2019appartenance politique, la situation personnelle et sociale ou \u00e9conomique.<\/p><p style=\"text-align: justify;\">\u2014 Appliquer les m\u00eames normes \u00e0 toutes les personnes inspect\u00e9es.<\/p><p style=\"text-align: justify;\">\u2014 Respecter et garantir le droit des personnes inspect\u00e9es d\u2019exprimer des observations et de soulever des objections au cours de l\u2019inspection.<\/p><p style=\"text-align: justify;\">\u2014 Ne pas faire de d\u00e9clarations publiques ou de commentaires sur des inspections en cours susceptibles de donner l\u2019impression de partialit\u00e9.<\/p><p style=\"text-align: justify;\">\u00c9viter les conflits d\u2019int\u00e9r\u00eats signifie ignorer les situations pouvant susciter des doutes quant \u00e0 l\u2019existence d\u2019un int\u00e9r\u00eat personnel direct ou indirect ou un autre int\u00e9r\u00eat pertinent pour l\u2019inspecteur charg\u00e9 de l\u2019inspection qui peut influencer l\u2019objectivit\u00e9 et l\u2019impartialit\u00e9 de l\u2019inspection ou susceptible de soulever un doute quant \u00e0 une telle influence.<\/p><p style=\"text-align: justify;\">Les hypoth\u00e8ses sp\u00e9cifiques de conflit d\u2019int\u00e9r\u00eats sont d\u00e9finies dans le droit national de chacun des \u00c9tats membres du r\u00e9seau et la pr\u00e9sente Charte se borne \u00e0 attirer l\u2019attention sur leur pertinence.<\/p><p style=\"text-align: justify;\">En cas de conflit d\u2019int\u00e9r\u00eats, les inspecteurs doivent se r\u00e9cuser.<\/p><p style=\"text-align: justify;\">En cas de suspicion de conflit d\u2019int\u00e9r\u00eats, les inspecteurs peuvent demander une consultation aupr\u00e8s de la direction du service ou \u00e0 une autre autorit\u00e9 d\u00e9ontologique si la l\u00e9gislation nationale l\u2019a pr\u00e9vue. La confidentialit\u00e9 doit \u00eatre garantie.<\/p><p style=\"text-align: justify;\">L\u2019impartialit\u00e9 est un facteur fondamental dans la construction et le maintien de l\u2019autorit\u00e9 et de la confiance dans le service d\u2019inspection et doit \u00eatre au centre de l\u2019attention de sa direction en priorit\u00e9.<\/p><p style=\"text-align: justify;\">Il est pr\u00e9cis\u00e9 que le pr\u00e9sent article de la Charte de d\u00e9ontologie est traduit dans la (les) langue(s) officielle(s) de chaque pays qui y adh\u00e8re, en consid\u00e9ration de son Etat de droit.<\/p><ol style=\"text-align: justify;\" start=\"3\"><li><strong>Int\u00e9grit\u00e9 <\/strong><\/li><\/ol><p style=\"text-align: justify;\">L\u2019int\u00e9grit\u00e9 correspond \u00e0 l\u2019exigence g\u00e9n\u00e9rale d\u2019honn\u00eatet\u00e9. Elle est un \u00e9l\u00e9ment essentiel du comportement requis pour la conduite des missions d\u2019inspection au sein du service et dans la soci\u00e9t\u00e9. L\u2019int\u00e9grit\u00e9 rev\u00eat de 4 nombreuses formes, qui ont toutes traits aux notions d\u2019int\u00e9grit\u00e9 et de dignit\u00e9 de la personne. Les personnes qui effectuent les inspections sont tenues de :<\/p><p style=\"text-align: justify;\">\u2014 \u00catre honn\u00eates et ouvertes dans leur comportement.<\/p><p style=\"text-align: justify;\">\u2014 Ne pas profiter de leur position professionnelle pour en tirer un avantage.<\/p><p style=\"text-align: justify;\">\u2014 Ne pas interc\u00e9der ou permettre d\u2019interc\u00e9der en faveur d\u2019une personne qui fait l\u2019objet d\u2019une inspection.<\/p><p style=\"text-align: justify;\">\u2014 Ne pas se livrer \u00e0 des actes allant \u00e0 l\u2019encontre des perceptions de d\u00e9cence \u00e9tablies dans la soci\u00e9t\u00e9.<\/p><p style=\"text-align: justify;\">\u2014 Ne pas accomplir d\u2019actes li\u00e9s \u00e0 leurs fonctions ou en dehors de cellesci qui portent atteinte au prestige du service d\u2019inspection judiciaire.<\/p><p style=\"text-align: justify;\">Lorsqu\u2019ils d\u00e9terminent les caract\u00e9ristiques d\u2019un comportement honn\u00eate exig\u00e9, les inspecteurs peuvent demander des consultations d\u00e9ontologiques avec la direction du service ou d\u2019autres organismes d\u00e9ontologiques, si la l\u00e9gislation nationale les a pr\u00e9vues. La confidentialit\u00e9 de ces consultations doit \u00eatre garantie.<\/p><ol style=\"text-align: justify;\" start=\"4\"><li><strong>Confidentialit\u00e9 et discr\u00e9tion professionnelle <\/strong><\/li><\/ol><p style=\"text-align: justify;\">Les membres concern\u00e9s des inspections de la justice doivent exercer leurs fonctions avec la plus grande discr\u00e9tion sur les faits et informations dont ils ont eu connaissance dans l\u2019exercice ou \u00e0 l\u2019occasion de l\u2019exercice de leurs fonctions.<\/p><p style=\"text-align: justify;\">Ils ne peuvent pas utiliser abusivement (en dehors de la nature de la v\u00e9rification) les informations dont ils ont eu connaissance dans l\u2019exercice de leurs fonctions.<\/p><p style=\"text-align: justify;\">Les membres des inspections de la justice ne doivent pas divulguer des informations sur la vie priv\u00e9e ou des donn\u00e9es personnelles prot\u00e9g\u00e9es des personnes inspect\u00e9es ou portant atteinte \u00e0 leurs int\u00e9r\u00eats prot\u00e9g\u00e9s ou \u00e0 leur r\u00e9putation.<\/p><p style=\"text-align: justify;\">Les inspecteurs sont tenus de respecter le caract\u00e8re confidentiel de leurs travaux le secret quand la loi l\u2019exige. Les inspecteurs sont tenus au devoir de r\u00e9serve ou de confidentialit\u00e9 conform\u00e9ment aux dispositions de leur l\u00e9gislation nationale.<\/p><ol style=\"text-align: justify;\" start=\"5\"><li><strong>\u00c9quit\u00e9 <\/strong><\/li><\/ol><p style=\"text-align: justify;\">L\u2019\u00e9quit\u00e9 est une attitude \u00e9thique \u00e0 l\u2019\u00e9gard de l\u2019\u00e9tablissement objectif des faits et de leur interpr\u00e9tation. La r\u00e9alisation du principe d\u2019\u00e9quit\u00e9 est soumise aux exigences suivantes:<\/p><p style=\"text-align: justify;\">\u2014 Lors de la r\u00e9alisation des inspections, collecter, v\u00e9rifier et analyser tous les faits pertinents concernant l\u2019objet de l\u2019inspection.<\/p><p style=\"text-align: justify;\">\u00a0\u2014 Lors de l\u2019adoption des conclusions (actes) des inspections, il convient d\u2019accorder une attention particuli\u00e8re aux questions susceptibles de restreindre ou d\u2019affecter ind\u00fbment la libert\u00e9 et\/ou la r\u00e9putation tant des personnes inspect\u00e9es que, le cas \u00e9ch\u00e9ant, des tiers directement ou indirectement concern\u00e9s par l\u2019inspection.<\/p><p style=\"text-align: justify;\">\u2014 Les inspecteurs sont guid\u00e9s par l\u2019exigence d\u2019\u00e9quit\u00e9 dans les cas o\u00f9 la loi leur permet de d\u00e9cider de certaines questions \u00e0 leur discr\u00e9tion.<\/p><ol style=\"text-align: justify;\" start=\"6\"><li><strong>Loyaut\u00e9 <\/strong><\/li><\/ol><p style=\"text-align: justify;\">La loyaut\u00e9 d\u00e9coule du devoir d\u2019int\u00e9grit\u00e9 auquel sont tenus les inspecteurs. Elle r\u00e9sulte de la transparence et de la lisibilit\u00e9 de leur action et implique l\u2019obligation de rendre compte de leur activit\u00e9. Elle s\u2019applique \u00e0 l\u2019\u00e9gard de l\u2019autorit\u00e9 mandante, des interlocuteurs des \u00e9quipes de mission et au sein du service d\u2019inspection. Elle impose le respect des principes directeurs r\u00e9gissant la conduite des missions.<\/p><p style=\"text-align: justify;\">En pratique, la loyaut\u00e9 dans les activit\u00e9s en mati\u00e8re d\u2019inspection de la justice est observ\u00e9e de plusieurs mani\u00e8res:<\/p><p style=\"text-align: justify;\">\u2014 Loyaut\u00e9 dans la conduite des missions.<\/p><p style=\"text-align: justify;\">\u2014 Loyaut\u00e9 s\u2019exprimant par l\u2019ex\u00e9cution de bonne foi des missions ordonn\u00e9es par l\u2019autorit\u00e9 mandante.<\/p><p style=\"text-align: justify;\">\u2014 Loyaut\u00e9 envers l\u2019autorit\u00e9 mandante.<\/p><p style=\"text-align: justify;\">\u2014 Lorsque les inspections sont effectu\u00e9es par le service d\u2019inspection en \u00e9quipe, la loyaut\u00e9 se manifeste par le partage des informations et le respect de la m\u00e9thodologie engag\u00e9e.<\/p><p style=\"text-align: justify;\">\u2014 Loyaut\u00e9 interinstitutionnelle lorsque les services d\u2019inspection collaborent avec d\u2019autres autorit\u00e9s et services, qui se manifeste dans la transparence dans la mani\u00e8re d\u2019agir, la bonne foi et les bonnes intentions envers ces autorit\u00e9s ou services.<\/p><ol style=\"text-align: justify;\" start=\"7\"><li><strong>R\u00e9serve et courtoisie <\/strong><\/li><\/ol><p style=\"text-align: justify;\">Au cours de leurs missions, les inspecteurs doivent faire preuve de respect, d\u2019attention et de tol\u00e9rance envers tous les organes inspect\u00e9s et ceux qui les composent.<\/p><p style=\"text-align: justify;\">La r\u00e9serve et la courtoisie doivent \u00e9galement \u00eatre manifest\u00e9es \u00e0 toutes les personnes entendues ou qui sont la source d\u2019autres informations lors des inspections.<\/p><p style=\"text-align: justify;\"><strong>\u00a0<\/strong><\/p><ol style=\"text-align: justify;\" start=\"8\"><li><strong>Comp\u00e9tence et qualification <\/strong><\/li><\/ol><p style=\"text-align: justify;\">L\u2019exigence de comp\u00e9tence et de perfectionnement professionnel est essentielle pour atteindre la qualit\u00e9, la rapidit\u00e9 et l\u2019efficacit\u00e9 des inspections effectu\u00e9es.<\/p><p style=\"text-align: justify;\">Les qualifications et les comp\u00e9tences \u00e9lev\u00e9es sont un facteur important pour satisfaire aux exigences d\u2019ind\u00e9pendance, d\u2019impartialit\u00e9 et d\u2019int\u00e9grit\u00e9 des inspecteurs.<\/p><p style=\"text-align: justify;\">La mise en place de m\u00e9canismes permettant de v\u00e9rifier les comp\u00e9tences et de cr\u00e9er les conditions d\u2019un perfectionnement professionnel continu est une pr\u00e9occupation majeure des services d\u2019inspection.<\/p><p style=\"text-align: justify;\">Le perfectionnement professionnel est encourag\u00e9 par le R\u00e9seau europ\u00e9en des services d\u2019inspection de la justice au moyen d\u2019initiatives appropri\u00e9es et d\u2019\u00e9changes d\u2019exp\u00e9riences.<\/p><ol style=\"text-align: justify;\" start=\"9\"><li><strong>Transparence des inspections effectu\u00e9es<\/strong><\/li><\/ol><p style=\"text-align: justify;\">La transparence est un facteur important de sensibilisation du public et de multiplication de l\u2019effet des r\u00e9sultats du travail des services d\u2019inspection. Elle contribue \u00e0 la pr\u00e9vention.<\/p><p style=\"text-align: justify;\">Les inspections de la justice fournissent au public, en temps utile, des informations compr\u00e9hensibles et objectives sur les inspections effectu\u00e9es. L\u2019information fournie au public par les services d\u2019inspection doit se faire au travers des m\u00e9canismes \u00e9tablis par la l\u00e9gislation nationale.<\/p><p style=\"text-align: justify;\">Les informations fournies doivent respecter les exigences de confidentialit\u00e9 et de discr\u00e9tion professionnelle pr\u00e9vues par la l\u00e9gislation nationale et par la pr\u00e9sente charte.<\/p><p style=\"text-align: justify;\">Sur la base des informations fournies, les inspections de la justice peuvent identifier les comportements r\u00e9guliers et irr\u00e9guliers selon les l\u00e9gislations nationales. Les informations fournies peuvent constituer une base et une occasion de discuter de questions \u00e9thiques et des cas sp\u00e9cifiques doivent \u00eatre d\u00fbment anonymis\u00e9s \u00e0 cette fin.<\/p><p style=\"text-align: center;\"><strong>CHAPITRE DEUX <\/strong><\/p><p style=\"text-align: center;\"><strong>M\u00c9CANISME DE SURVEILLANCE ET DE CONTR\u00d4LE <\/strong><\/p><p style=\"text-align: justify;\">Les principes \u00e9nonc\u00e9s dans la pr\u00e9sente Charte servent de lignes directrices pour les normes \u00e9thiques de base exig\u00e9es des chefs des inspections de la justice et des inspecteurs dans l\u2019exercice de leurs fonctions. Elles ont un caract\u00e8re consultatif et visent \u00e0 aider les chefs des inspections de la justice et les inspecteurs en ce qui concerne les questions \u00e9thiques et professionnelles qu\u2019ils rencontrent.<\/p><p style=\"text-align: justify;\">La charte est publi\u00e9e sur le site internet du R\u00e9seau Europ\u00e9en des Services d\u2019Inspection de la Justice et sur le site internet de chaque service d\u2019inspection qui est membre du R\u00e9seau europ\u00e9en des services d\u2019inspection de la justice.<\/p><p style=\"text-align: justify;\">Les autorit\u00e9s et les pouvoirs auxquels la fonction des services d\u2019inspection est d\u00e9volue conform\u00e9ment \u00e0 la l\u00e9gislation nationale, veilleront au respect et \u00e0 l\u2019application des r\u00e8gles et principes de la pr\u00e9sente Charte.<\/p><p style=\"text-align: center;\"><strong>DISPOSITION SUPPL\u00c9MENTAIRE<\/strong><\/p><p style=\"text-align: justify;\">Dans les \u00c9tats membres du R\u00e9seau, o\u00f9 il n\u2019existe pas d\u2019organisme d\u2019inspection pr\u00e9vu par la loi, dot\u00e9 d\u2019une personnalit\u00e9 juridique, distincte ou au sein d\u2019une autorit\u00e9 judiciaire sup\u00e9rieure (conseil sup\u00e9rieur de la justice, ministre de la justice), les principes et r\u00e8gles de la pr\u00e9sente Charte ne s\u2019appliquent que s\u2019ils sont compatibles avec la r\u00e8glementation du droit national.
