Heads and representatives of inspection services!<\/em><\/p>

Dear ladies and gentlemen!<\/em><\/p>

Good morning and welcome to Albania to all our guests and welcome to this conference to all of you.<\/p>

Today<\/strong> I feel deeply privileged, as the host country, to open this conference and highly appreciated by all the participants and my colleagues from the European Justice Inspection Services, who are here to be part of this conference! Thank you everyone<\/em>!<\/p>

At the same time, Today<\/strong> I feel confident that undertaking this so ambitious initiative is priceless for us all and absolutely necessary.<\/p>

The idea of organizing this activity was born quite naturally while sharing some thoughts and ideas with my Romanian counterpart Mr. Lucian Netoroju, on some issues regarding the administration of justice, the independence of magistrates as well as the role of inspection services in this process.<\/p>

We both shared the same position: despite the differences and diversity of our political, legal, social or economic cultures, history in Europe and outside of it, is showing that the independence of magistrates should not be taken for granted, yet it remains an issue that belongs to all countries. This is the standard of a common dimension of our societies. This is an international standard.<\/p>

Today all countries must step up their efforts to strengthen this independence, and at the same time to increase the efficiency and accountability of the organs of the justice system. These are two things that cannot work separately. The more accountable the magistrate is, the more guaranteed is the citizen for his rights. The more independent a magistrate is, the more democratic is the society. Both these standards, the quality of justice and the independence of magistrates are a priority for all countries.<\/p>

In this context, finding a balance between the public interest in the administration of justice on the one hand and the independence of magistrates on the other, remains a permanent challenge because the independence of magistrates and their accountability are dynamic values. Social developments undoubtedly bring about social and economic transformations and the independence\/ accountability ratio always remains a professional and institutional challenge.<\/p>

With this in mind, there is a need for all of us to find the right way to collaborate and identify the best opportunities and methods of communicating and exchanging with each other.<\/p>

This is how this idea was conceived, and day by day with the contribution of RESIJ and CEPEJ, who I would like to sincerely thank, this ambition became a reality today<\/strong>.<\/p>

Dear ladies and gentlemen!<\/p>

Justice has its own contribution to the life and quality of any society. Creating the rule of law model is not an easy process. In all countries, this is a dynamic and constantly evolving process in order to find the right mechanisms which ensure the compliance with a set of standards or values for an efficient, accountable and independent justice system.<\/p>

Albania has carried out a profound legal and institutional reform in justice system. Specifically, to find these mechanisms and to adapt to the development stage of its society. This reform was strongly supported in every aspect by valuable partners such as the European Union and the United States of America, and now the challenge of developing this reform is the responsibility of the actors of justice.<\/p>

In this context, a conference like this one, today, in Tirana on this important topic, beyond discussions with each other, is a real contribution to the vision and daily work of the High Inspector of Justice Institution, but also of other bodies of justice system in Albania<\/p>

Respect for human rights, democracy and the rule of law are key assets of the European Union and safeguarding or ensuring them is a shared responsibility of all EU institutions as well as its member states. Accessing them however, should not be seen as a boundary, a barrier or condition to other non-member states, but as a symbol which unites us all. Europe before being a political project is a system of human values. As in the words of Jean Monnet, the European Union does not aim at forming coalitions between states<\/em>, but above all union among people<\/em> who believe and live in the system of European values.<\/p>

In this context, I believe that today we should all cooperate. We all need to analyse, use each other’s best models and coordinate methods of controlling and evaluating justice institutions according to our common European values, regardless our political, legal or social differences.<\/p>

I hope that not only does this organization for the first time in Albania, achieve these goals, but it can also be the starting point of a tradition which will continue.<\/p>

Bonjour et soyez les bienvenus en Albanie, \u00e0 tous les invit\u00e9s, et bienvenue \u00e0 tous dans cette conf\u00e9rence !<\/p>

Aujourd\u2019hui je me sens privil\u00e9gi\u00e9, d\u2019inaugurer les travaux de cette conf\u00e9rence en tant que pays organisateur et je me sens tr\u00e8s appr\u00e9ci\u00e9 par tous les pr\u00e9sents et les coll\u00e8gues des Services Europ\u00e9ens d\u2019Inspection de la Justice, qui participent dans cette conf\u00e9rence.<\/p>

Merci \u00e0 tous !<\/p>

En m\u00eame temps, aujourd’hui je suis tout \u00e0 fait convaincu, qu\u2019entreprendre une telle initiative si ambitieuse a de la valeur pour nous tous et que sa mat\u00e9rialisation \u00e9tait plus qu\u2019indispensable.<\/p>

L\u2019id\u00e9e de l\u2019organisation de cette activit\u00e9 est n\u00e9e tout naturellement, tout en partageant quelques r\u00e9flexions avec mon homologue roumain, M. Lucian Netejoru, sur certaines questions li\u00e9es \u00e0 l’administration de la justice, \u00e0 l’ind\u00e9pendance des magistrats, ainsi qu’au r\u00f4le des services d\u2019inspection dans ce processus.<\/p>

Nous partagions tous les deux la m\u00eame opinion que, malgr\u00e9 les diff\u00e9rences et la diversit\u00e9 de nos cultures politiques, juridiques, sociales ou \u00e9conomiques, l’histoire en Europe et \u00e0 l’ext\u00e9rieur montre que l’ind\u00e9pendance des magistrats ne doit pas \u00eatre consid\u00e9r\u00e9e comme acquise, au contraire, elle demeure une question appartenant \u00e0 tous les pays. C’est la norme d’une dimension commune de nos soci\u00e9t\u00e9s. Il s’agit d’une norme internationale.<\/p>

Aujourd’hui, tous les pays doivent intensifier leurs efforts pour renforcer cette ind\u00e9pendance, mais aussi pour augmenter l’efficacit\u00e9 et la responsabilit\u00e9 des organes du syst\u00e8me de la justice. Les deux ne peuvent marcher qu\u2019ensemble. Plus un magistrat est ind\u00e9pendant, plus les droits du citoyen sont garantis. Plus le magistrat est responsable, plus la soci\u00e9t\u00e9 avance d\u00e9mocratiquement. Ces deux normes, la qualit\u00e9 de la justice et l’ind\u00e9pendance des magistrats, sont une priorit\u00e9 pour tous les pays.<\/p>

Dans ce contexte, trouver un \u00e9quilibre entre l’int\u00e9r\u00eat public dans l’administration de la justice, d’une part, et l’ind\u00e9pendance des magistrats, de l\u2019autre, reste un d\u00e9fi permanent, car l’ind\u00e9pendance des magistrats et leur responsabilit\u00e9 sont des valeurs dynamiques. Les \u00e9volutions sociales entra\u00eenent sans aucun doute des transformations sociales et \u00e9conomiques et le rapport autonomie\/responsabilit\u00e9 reste toujours un enjeu professionnel et institutionnel.<\/p>

Dans cet esprit, nous devons tous trouver la bonne fa\u00e7on de coop\u00e9rer et identifier les meilleures opportunit\u00e9s et m\u00e9thodes de communication et d’\u00e9change les uns avec les autres.<\/p>

C’est ainsi que cette id\u00e9e a \u00e9t\u00e9 con\u00e7ue et jour apr\u00e8s jour avec la contribution du RESIJ et de la CEPEJ, que je tiens \u00e0 remercier vivement, aujourd’hui cette ambition est devenue r\u00e9alit\u00e9.<\/p>

Mesdames et Messieurs !<\/p>

La justice a sa contribution \u00e0 la vie et \u00e0 la qualit\u00e9 de toute soci\u00e9t\u00e9. La cr\u00e9ation d’un mod\u00e8le d’\u00c9tat de droit n’est pas un processus facile. Il s’agit d’un processus dynamique et en constante \u00e9volution pour trouver les bons m\u00e9canismes, qui garantissent le respect d’un ensemble de normes ou de valeurs pour un syst\u00e8me de justice efficace, responsable et ind\u00e9pendant.<\/p>

L’Albanie a r\u00e9alis\u00e9 une profonde r\u00e9forme juridique et institutionnelle du syst\u00e8me judiciaire. Pr\u00e9cis\u00e9ment pour trouver ces m\u00e9canismes et s’adapter au stade de d\u00e9veloppement de sa soci\u00e9t\u00e9. Cette r\u00e9forme a \u00e9t\u00e9 fortement soutenue dans tous les sens par des partenaires pr\u00e9cieux, tels que l’Union Europ\u00e9enne et les \u00c9tats-Unis d’Am\u00e9rique et maintenant le d\u00e9fi de d\u00e9velopper et d\u2019implementer cette r\u00e9forme est de la responsabilit\u00e9 des acteurs de la justice.<\/p>

Dans ce contexte, une telle conf\u00e9rence \u00e0 Tirana avec ce sujet important, au-del\u00e0 des discussions entre nous, est une contribution r\u00e9elle \u00e0 la vision et au travail quotidien de l’institution du Haut Inspecteur de la Justice, mais je crois aussi pour d’autres organes du syst\u00e8me judiciaire en Albanie.<\/p>

Le respect des droits de l’homme, la d\u00e9mocratie et l’\u00c9tat de droit sont des atouts essentiels de l’Union Europ\u00e9enne et leur sauvegarde ou garantie, rel\u00e8ve de la responsabilit\u00e9 partag\u00e9e de toutes les institutions de l’UE, ainsi que de ses \u00c9tats membres. Toutefois cette approche ne doit pas \u00eatre consid\u00e9r\u00e9e comme une limite, une barri\u00e8re ou une condition pour les autres \u00c9tats non-membres, mais comme un symbole qui nous unit tous. L’Europe, avant d’\u00eatre un projet politique est un syst\u00e8me de valeurs humaines. Comme le disait Jean Monnet, l’Union Europ\u00e9enne ne vise pas l’union des \u00c9tats, mais avant tout l’union des peuples qui croient et vivent dans le syst\u00e8me de valeurs europ\u00e9ennes.<\/p>

Dans ce contexte, je pense que nous devons tous coop\u00e9rer aujourd’hui. Nous devons tous analyser, prendre les meilleurs mod\u00e8les les uns des autres et coordonner les m\u00e9thodes de contr\u00f4le et d’\u00e9valuation des institutions judiciaires conform\u00e9ment \u00e0 nos valeurs europ\u00e9ennes communes, quelles que soient nos diff\u00e9rences politiques, juridiques ou sociales.<\/p>

J’esp\u00e8re que cette organisation, pour la premi\u00e8re fois en Albanie aujourd’hui, n’atteindra pas seulement ces objectifs, mais qu’elle sera \u00e9galement le point de d\u00e9part d’une tradition qui se poursuivra.<\/p>
