At the initiative of High Inspector of Justice Mr. Artur Metani, the International Conference on “Public interest in the administration of justice and the independence of magistrates” was held in the Presidential Palace. Participants were heads and representatives of justice inspection services from European Union countries, namely Belgium, Bulgaria, France, Greece, Italy, Portugal, Romania, Spain and Albania.<\/p>

The conference was organized by the European Network of Justice Inspection Services (RESIJ) and the High Inspector of Justice, in cooperation with CEPEJ (Strengthening the Quality and Efficiency of Justice in Albania, SEJ III), with the support of the joint program of the European Union and Council of Europe “The Horizontal Facility for the Western Balkans and Turkey 2019-2022”<\/p>

The European Network of Justice Inspection Services (RESIJ) was established in 2017 and consists of inspection institutions from European Union countries with the support of the European Commission. The High Inspector of Justice has been an observer member of RESIJ since December 2021.<\/p>

The conference was greeted by the Speaker of the Assembly Mrs. Lindita Nikolla; Charge d’Affaires of the EU Delegation Mr. Alexis Hupin; the Charge d’Affaires of the US Embassy Mr. Demian Smith, Deputy Head of the Council of Europe Office Mr. Olsi Dekovi, Coordinator of the European Justice Inspection Network (RESIJ) Ms. Delphine Agoguet and the Secretary of CEPEJ (European Commission for the Efficiency of Justice) Mrs. Muriel Decot.<\/p>

In his welcome speech, High Inspector of Justice Mr. Artur Metani emphasized the need cooperation between inspection services in order to use each other’s best models and coordinate methods of controlling and evaluating justice institutions according to our common European values, despite the diversity of political, legal, social or economic cultures.<\/p>

\u201cHistory in Europe and outside of it, is showing that the independence of magistrates should not be taken for granted, yet it remains an issue that belongs to all countries. This is the standard of a common dimension of our societies. This is an international standard. Today all countries must step up their efforts to strengthen this independence, and at the same time to increase the efficiency and accountability of the organs of the justice system. These are two things that cannot work separately. The more accountable the magistrate is, the more guaranteed is the citizen for his rights. The more independent a magistrate is, the more democratic is the society. Both these standards, the quality of justice and the independence of magistrates are a priority for all countries.\u201d, said Mr. Metani<\/p>

Speaker of the Assembly Mrs. Lindita Nikolla praised in her speech, the change that has taken place since the adoption of the justice reform. \u201cToday, the real independence of judges and prosecutors is being consolidated in parallel with their “dependence” on the Republic, the Constitution, laws and the public interest. The justice system had reached a point where it did not hide its dependence, both political and financial one. Today, the threads that connected the system with the above corrupt forms have been torn and are being torn day by day. The judiciary is being built, strengthened and affirmed as an independent power. The other myth, that the system cannot self-reform, is also collapsing. In this regard, the High Inspectorate of Justice, one of the new and most important governing bodies of the system, has its own merit.\u201d<\/p>

The Charge d’Affaires of the EU Delegation, Mr. Alexis Hupin underlined in his speech the great work that has been done with the justice reform, as a European practice yet a new practice for Albania which comes along with its challenges amid its rules in addition to relieving the burden of backlog cases, in addition to communicating with the public but also the recruiting more inspectors in the case of the High Inspector of Justice. “However, after two years, we estimate that you have really met the expectations and there is still a lot of work to be done. As the Madam Speaker said, you have come a long way, but the inappropriate influences and interventions in the affairs of the judiciary still continue. They take different forms. They also take the form of attacks on justice reform as a whole, but sometimes they also take the form of attacks on judges and prosecutors. “Consequently, I would like to thank the High Inspector of Justice for his very professional behaviour towards this pressure to keep the judiciary accountable but also to maintain, what is very important, its independence,” said Mr. Hupin.<\/p>

US Embassy Charg\u00e9 d’Affaires Mr. Demian Smith mentioned in his speech that today we are starting to see a new era where the system can serve its citizens, and not just the politicians, politically connected people, the wealthy, and the criminal. \u201cThe United States encourages you to keep up the good work and the hard work, regardless of the obstacles you face.\u00a0 Alongside our EU partners \u2013 and I want to echo the comments of my EU colleague on the close U.S.-EU partnership on justice reform – we supported the initiation of Justice Reform in 2016, and we have been there every step of the way, through vetting and the creation of the new institutions.\u00a0 We are starting to see the impact of a cleaner judiciary and dedicated anti-corruption prosecutors and investigators. It depends on the vigilance and commitment of institutions like the High Inspectorate of Justice to maintain progress against corruption and ensure the integrity of the judicial system. Today, you have important discussions with European partners on what is working and what can be done better. In the end, real, meaningful change, it is up to you, the stakeholders in the justice system, to embrace reform and to make the system work for every Albanian.\u201d, said among other things Mr. Smith.<\/p>

Deputy Head of the Council of Europe Office, Mr. Olsi Dekovi said: \u201cThe independence of the judiciary requires the co-operation of different institutions and legal instruments as well as a combination of conditions and measures that may be different in different countries where each finds its own balance. I am confident that today\u2019s conference will help build a platform for judicial inspectors to present, discuss and share their experiences, ideas and research, including the challenges of judicial inspection.\u201d<\/p>

Coordinator of the European Network of Justice Inspection Services (RESIJ) magistrate inspector Mrs. Delphine Agoguet thanked the High Inspector of Justice for organizing this meeting in Tirana and said that the Inspection services in Europe may have very different dependency organizations but have the same work objective. \u201cA justice system cannot be efficient and independent if it cannot rely on an inspection system that possesses the same qualities. In all countries, all the authorities in charge of control have this great responsibility to establish and rebuild the citizen’s trust in justice. Contributing to the strengthening of these authorities and services is one of the main missions set by the European Network of Justice Inspection Services.\u00bb<\/p>

In her address, Muriel Decot \u2013 Secretary of the European Commission for the Efficiency of Justice (CEPEJ) focused on the important role of the High Inspector of Justice to ensure that judges and prosecutors uphold the highest professional standards and deliver justice to all citizens. \u201cI take this opportunity to reiterate CEPEJ\u2019s commitment to continue supporting the justice reforms in Albania and the High Inspector of Justice as a key institution of the Albanian justice system\u201d, concluded Decot.<\/span><\/p>

Sous l’initiative du Haut Inspecteur de la Justice M. Artur Metani s’est tenu au Palais Pr\u00e9sidentiel \u00e0 Tirana, la Conf\u00e9rence Internationale sur \u00ab L’int\u00e9r\u00eat public dans l’administration de la justice et l’ind\u00e9pendance des magistrats \u00bb. Ils y participaient des dirigeants et des repr\u00e9sentants des Services d’Inspection de la Justice des pays de l’Union europ\u00e9enne, \u00e0 savoir la Belgique, la Bulgarie, la France, la Gr\u00e8ce, l’Italie, le Portugal, la Roumanie, l’Espagne et l’Albanie.<\/p>

La conf\u00e9rence est une organisation du R\u00e9seau Europ\u00e9en des Services de Justice (RESIJ) et du Haut Inspecteur de la Justice d\u2019Albanie (HIJ), en coop\u00e9ration avec la CEPEJ (Renforcement de la qualit\u00e9 et de l’efficacit\u00e9 de la justice en Albanie, SEJ III), avec le soutien du programme conjoint de l’Union Europ\u00e9enne et “Instrument horizontal pour les Balkans occidentaux et la Turquie 2019-2022” du Conseil de l’Europe.<\/p>

Dans son discours le Haut Inspecteur de la Justice, M. Artur Metani a soulign\u00e9 la n\u00e9cessit\u00e9 d’une coop\u00e9ration entre les services d’inspection, pour obtenir les meilleurs mod\u00e8les les uns des autres, pour coordonner les m\u00e9thodes de contr\u00f4le et d’\u00e9valuation des institutions de justice conform\u00e9ment aux valeurs communes europ\u00e9ennes et malgr\u00e9 la diversit\u00e9 des cultures politiques, juridiques, sociales ou \u00e9conomiques.<\/p>

\u201cL’histoire en Europe et \u00e0 l’ext\u00e9rieur montre que l’ind\u00e9pendance des magistrats ne doit pas \u00eatre consid\u00e9r\u00e9e comme acquise, au contraire, elle demeure une question appartenant \u00e0 tous les pays. C’est la norme d’une dimension commune de nos soci\u00e9t\u00e9s. Il s’agit d’une norme internationale. Aujourd’hui, tous les pays doivent intensifier leurs efforts pour renforcer cette ind\u00e9pendance, mais aussi pour augmenter l’efficacit\u00e9 et la responsabilit\u00e9 des organes du syst\u00e8me de la justice. Les deux ne peuvent marcher qu\u2019ensemble. Plus un magistrat est ind\u00e9pendant, plus les droits du citoyen sont garantis. Plus le magistrat est responsable, plus la soci\u00e9t\u00e9 avance d\u00e9mocratiquement. Ces deux normes, la qualit\u00e9 de la justice et l’ind\u00e9pendance des magistrats, sont une priorit\u00e9 pour tous les pays.<\/em>\u201d,<\/em> a dit M. Metani.<\/p>

La Pr\u00e9sidente de l’Assembl\u00e9e Mme. Lindita Nikolla a salu\u00e9 le changement survenu a l’adoption de la r\u00e9forme dans se syst\u00e8me judiciaire. \u00ab\u00a0Aujourd’hui<\/em>, – a dit Mme Nikolla, – l’ind\u00e9pendance r\u00e9elle des juges et des procureurs se renforce parall\u00e8lement \u00e0 leur “d\u00e9pendance” vis-\u00e0-vis de la R\u00e9publique, de la Constitution, des lois et de l’int\u00e9r\u00eat public. La justice \u00e9tait arriv\u00e9e \u00e0 un point o\u00f9 elle ne cachait plus sa d\u00e9pendance, tant politique que financi\u00e8re. Aujourd’hui, les fils qui reliaient le syst\u00e8me aux formes corrompues ci-dessus ont \u00e9t\u00e9 coup\u00e9s et se coupent encore jour apr\u00e8s jour. Le pouvoir judiciaire se construit, se renforce et s’affirme en tant que pouvoir ind\u00e9pendant. L’autre mythe, selon lequel le syst\u00e8me ne peut pas s’auto-r\u00e9former, est en train de s’effondre \u00e9galement. A cet \u00e9gard, la Haute Inspection de la Justice, l’une des nouvelles et des plus importantes instances dirigeantes du syst\u00e8me, a son m\u00e9rite.<\/em> \u00bb<\/p>

Le charg\u00e9 d’affaires de la d\u00e9l\u00e9gation de l’UE, M. Alexis Hupin a soulign\u00e9 dans son adresse l’excellent travail qui a \u00e9t\u00e9 fait avec la r\u00e9forme dans le syst\u00e8me judiciaire, en tant que pratique europ\u00e9enne, mais une nouvelle pratique pour l’Albanie qui comporte de d\u00e9fis aussi avec les r\u00e8gles, en plus d’all\u00e9ger le fardeau des dossiers en attente, en plus de la communication avec le public, mais aussi le recrutement de plus d’inspecteurs dans le cas du Haut Inspecteur de la Justice. “Cependant, apr\u00e8s deux ans, nous estimons que vous avez vraiment r\u00e9pondu aux attentes, m\u00eame s\u2019il reste encore beaucoup de travail \u00e0 faire. Comme l’a dit Madame la Pr\u00e9sidente, vous avez parcouru un long chemin, mais les influences et les interventions inappropri\u00e9es dans les affaires de la justice se poursuivent. Ils prennent diff\u00e9rentes formes. Elles prennent \u00e9galement la forme d’attaques contre la r\u00e9forme de la justice dans son ensemble, mais parfois elles prennent aussi la forme d’attaques contre les juges et les procureurs. Par cons\u00e9quent, je tiens \u00e0 remercier le Haut Inspecteur de la Justice pour son comportement tr\u00e8s professionnel face \u00e0 cette pression pour responsabiliser la justice mais aussi pour la prot\u00e9ger, ce qui est tr\u00e8s important pour son ind\u00e9pendance”<\/em>, a d\u00e9clar\u00e9 M. Hupin.<\/p>

Le Charg\u00e9 d’Affaires de l’Ambassade des \u00c9tats-Unis, M. Demian Smith a not\u00e9 dans son discours qu’aujourd’hui nous assistons \u00e0 une nouvelle \u00e8re o\u00f9 le syst\u00e8me commence \u00e0 servir les citoyens et pas seulement les politiciens, les personnes ayant des liens politiques, riches ou incrimin\u00e9s. “Les \u00c9tats-Unis vous encouragent \u00e0 poursuivre votre bon travail et votre travail acharn\u00e9, malgr\u00e9 les obstacles auxquels vous \u00eates confront\u00e9s. Avec nos partenaires de l’UE – et je veux me joindre aux commentaires de mon coll\u00e8gue de l’UE sur le partenariat \u00e9troit entre les \u00c9tats-Unis et l’Union europ\u00e9enne sur la r\u00e9forme de la justice – nous avons soutenu le lancement de la r\u00e9forme dans le syst\u00e8me judiciaire en 2016 et nous avons \u00e9t\u00e9 pr\u00e9sents \u00e0 chaque \u00e9tape du processus, dans le vetting et la cr\u00e9ation de nouvelles institutions. On commence \u00e0 voir l’impact d’un syst\u00e8me judiciaire plus propre et de procureurs et d’enqu\u00eateurs d\u00e9vou\u00e9s contre la corruption. Toutefois cela d\u00e9pend de la vigilance et de l’engagement d’institutions, telles que la Haute Inspection de la Justice pour maintenir les progr\u00e8s contre la corruption et garantir l’int\u00e9grit\u00e9 du syst\u00e8me judiciaire. Aujourd’hui, vous aurez des discussions importantes avec des partenaires europ\u00e9ens sur ce qui fonctionne et ce qui peut \u00eatre am\u00e9lior\u00e9. En fin de compte, un changement r\u00e9el et significatif, c’est \u00e0 vous, les parties prenantes du syst\u00e8me judiciaire, pour embrasser la r\u00e9forme et de faire en sorte que le syst\u00e8me fonctionne pour chaque Albanais.\u00a0\u00bb a dit entre autres M. Smith.<\/p>

Le chef adjoint du Bureau du Conseil de l’Europe, M. Olsi Dekovi, a d\u00e9clar\u00e9 que “L’ind\u00e9pendance du pouvoir judiciaire exige la coop\u00e9ration de diff\u00e9rentes institutions et instruments juridiques ainsi qu’une combinaison de conditions et de mesures qui peuvent \u00eatre diff\u00e9rentes selon les pays o\u00f9 chacun trouve son propre \u00e9quilibre. Je suis convaincu que la conf\u00e9rence d’aujourd’hui contribuera \u00e0 cr\u00e9er une plateforme permettant aux inspecteurs judiciaires de pr\u00e9senter, discuter et \u00e9changer leurs exp\u00e9riences, leurs id\u00e9es et leurs recherches, y compris les d\u00e9fis de l’inspection judiciaire. \u00bb<\/p>

La coordinatrice du R\u00e9seau Europ\u00e9en d’Inspection Judiciaire (RESIJ) Magistrat Inspecteur Mme. Delphine Agoguet a remerci\u00e9 le Haut Inspecteur de la Justice pour l’organisation de cette conf\u00e9rence \u00e0 Tirana et a indiqu\u00e9 que les services d’inspection en Europe peuvent avoir des organisations diff\u00e9rentes mais ont le m\u00eame objectif de travail. \u00ab\u00a0Une justice ne peut \u00eatre efficace et ind\u00e9pendante si elle ne peut s’appuyer sur un syst\u00e8me d’inspection qui poss\u00e8de les m\u00eames qualit\u00e9s.\u00a0Dans tous les pays, toutes les autorit\u00e9s en charge du contr\u00f4le ont cette grande responsabilit\u00e9 d’\u00e9tablir et de reconstruire la confiance du citoyen dans la justice. Contribuer au renforcement de ces autorit\u00e9s et services est l’une des principales missions du R\u00e9seau europ\u00e9en d’inspection de la justice. \u00bb<\/p>

Dans son allocution, Mme Muriel Decot – Secr\u00e9taire de la Commission europ\u00e9enne pour l’efficacit\u00e9 de la justice (CEPEJ) a mis l’accent sur le r\u00f4le important du Haut Inspecteur de la Justice pour garantir que les juges et les procureurs respectent les normes professionnelles les plus \u00e9lev\u00e9es et rendent la justice \u00e0 tous les citoyens. “Je saisis cette occasion pour r\u00e9it\u00e9rer l’engagement de la CEPEJ \u00e0 continuer de soutenir la r\u00e9forme dans le syst\u00e8me judiciaire en Albanie et le Haut Inspecteur de la Justice en tant qu’institution cl\u00e9 du syst\u00e8me judiciaire albanais”, a conclu\u00a0Mme Decot.<\/p>
