{"id":20272,"date":"2024-04-11T07:14:15","date_gmt":"2024-04-11T06:14:15","guid":{"rendered":"https:\/\/ild.al\/?p=20272"},"modified":"2024-06-25T08:33:16","modified_gmt":"2024-06-25T06:33:16","slug":"hjc-accepts-hij-request-for-dismissal-of-magistrate-m-m","status":"publish","type":"post","link":"https:\/\/ild.al\/en\/2024\/04\/11\/hjc-accepts-hij-request-for-dismissal-of-magistrate-m-m\/","title":{"rendered":"HJC ACCEPTS HIJ REQUEST FOR DISMISSAL OF MAGISTRATE M.M."},"content":{"rendered":"<div data-elementor-type=\"wp-post\" data-elementor-id=\"20272\" class=\"elementor elementor-20272\" data-elementor-post-type=\"post\">\n\t\t\t\t\t\t<section class=\"has_eae_slider elementor-section elementor-top-section elementor-element elementor-element-4f69571 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-eae-slider=\"25638\" data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" data-id=\"4f69571\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"has_eae_slider elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-cc6a685\" data-eae-slider=\"20458\" data-id=\"cc6a685\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-e5adcec elementor-widget elementor-widget-text-editor\" data-id=\"e5adcec\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p style=\"text-align: justify;\">Today, the High Judicial Council has accepted the request of the High Inspector of Justice for the disciplinary proceedings &#8220;Dismissal from office&#8221; against magistrate M.M., judge at Durr\u00ebs Judicial District Court, for the disciplinary violation provided for by Article 140, paragraph 2. letter &#8220;b&#8221; of the Constitution of the Republic of Albania, as well as article 104 of law no. 96\/2016 &#8220;On the Status of Judges and Prosecutors in the Republic of Albania&#8221;, as amended, due to the conviction for committing the criminal offense of &#8220;Passive corruption of the judge, prosecutor, and other officials of the justice bodies&#8221; committed in cooperation, provided by article 319\/\u00e7 &#8211; 25 of the Criminal Code.<\/p><p style=\"text-align: justify;\">During the hearing, the HIJ inspectors concluded that the magistrate was found guilty by the Special Court of First Instance against Corruption and Organized Crime as well as the Court of Appeal, for more serious crimes, such as acts of corruptions related to the exercise of function of the judge, that constitute a criminal offense.
