HIGH JUDICAL COUNCIL ACCEPTS THE REQUEST OF THE HIGH INSPECTOR OF JUSTICE FOR DISMISSAL OF JUDGE M.K

The High Judicial Council (HJC) accepts the High Inspector of Justice request for the disciplinary measure of dismissal of Judge M.K. of Korça Judicial District Court.

The chairperson Naureda Llagami announced the decision according to which the HJC, unanimously decided to dismiss the judge of Korça M.K.

In the conclusions of the investigation, the High Inspector of Justice Artur Metani argued that the actions and inactions taken by the judge have undermined the trust that the magistrate should convey to the public in fulfilling his mission and his role in administering justice; they have severely discredited the figure and the position of the judge and have diminished the dignity of the body he represents, making him unworthy of continuing to perform the duty of Judge.

The High Inspector of Justice launched the disciplinary investigation against Judge M.K. on April 2, 2020, based on a request filed by the Minister of Justice, after the judge decided/ordered on 14.02.2019, the release of the prisoner sentenced to life imprisonment Gerd Gjenerari, found guilty of a murder committed in 1997. The decision to release the prisoner was reversed by the Appeal Court of Korca six months later.

The High Inspector of Justice has shared the public concern about the decision-making and the activity of other institutions regarding early parole, defining this phenomenon as a priority in initiating the inspection of HIJ, since taking office.

Other magistrates are in the process of investigation for similar decision-making by the High Inspector of Justice and having completed the investigation, the HIJ will take the relevant decisions.
