Admissibility of the Complaint

Having received your complaint, the High Inspector of Justice confirms its receipt in writing within 5 days. Once the complaint has been confirmed, the High Inspector of Justice will review it within three months from receiving it. But due to the stock of several-year-old files, inherited from other institutions, HIJ respects an approved methodology for examining each complaint, according to criteria related to the date of delivery, stage of treatment, typology or urgency of treatment and in function of the statute of limitations. The review ensures that the complaint meets the conditions set by law to be admissible. This review concerns the verification of information regarding: 

  • Manner of filing, i.e. if the complaint is submitted in writing;
  • Information such as your name, surname and address;
  • A description of the facts and circumstances you are complaining about; (Example)
  • The name and surname of the judge or prosecutor, together with the court or prosecutor’s office where he / she exercised the function at the time when the circumstance or fact against which you are complaining occurred;
  • The alleged violation occurred within 5 years from the moment of filing the complaint; (Examples)
  • There are no abusive elements in the content, it is not completely unfounded or repeated by the same complainant; (Example)
  • The conduct of the magistrate, who was in office at the time the circumstance or fact you complained about occurred; (Examples)
  • Conduct of the magistrate, provided as a disciplinary violation by the law in force at the time when the alleged violation occurred; (Examples)
  • The conduct of the magistrate which, if proven to have been committed, constitutes a disciplinary violation provided by law. (Examples)

Only after all these conditions are met, is the complaint accepted and then it is continued with the procedures for verifying the allegations raised in the complaint. If one or more of the criteria set out above are not met, the High Inspector of Justice issues a decision to dismiss the complaint and archive it. You will be notified of the decision to dismiss the complaint and of your right to appeal this decision as well as the time limit on appealing.
