THIS IS HOW EASY IT IS TO COMPLAIN WITH THE HIJ!

The Office of the High Inspector of Justice offers a simplified complaint process through our website. This makes the procedure as easy as possible for citizens or institutions who want to file allegations of violations by judges and prosecutors in Albania.

Si Pranohen Ankesat

Inspektori i Lartë i Drejtësisë, pas marrjes së ankesës brenda 5 ditëve nga marrja konfirmon me shkresë marrjen e saj. Pasi është konfirmuar marrja e ankesës, Inspektori i Lartë i Drejtësisë ka afat 3 tre muaj nga marrja e saj t’a shqyrtojë duke filluar kontrollin. Kontrolli siguron që ankesa plotëson kushtet që ka vendosur ligji për të qenë e pranueshme. Kontrolli i pranueshmërisë, ka të bëjë me:

Mënyrë e paraqitjes, pra nëse ankesa është e paraqitur me shkrim;
Të dhënat si emri, mbiemri dhe adresa juaj;
Përshkrimin e fakteve dhe rrethanave për të cilat ankoheni;
Emrin, mbiemrin e gjyqtarit apo prokurorit, bashkë me gjykatën apo prokurorinë ku ka ushtruar funksionin në kohën kur ka ndodhur rrethana apo fakti ndaj të cilit ankoheni;
faktet kanë ndodhur pas 5 viteve nga koha kur ka ndodhur fakti apo rrethana e pretenduar.
në përmbajtje nuk ka elemente abuzive, nuk është haptazi e pabazuar ose e përsëritur nga i njëjti ankues;
sjelljen e magjistratit, i cili ka qenë në detyrë në kohën kur ka ndodhur rrethana apo fakti për të cilën ankoheni;
sjelljen së magjistratit, të parashikuar si shkelje disiplinore nga ligji në fuqi në kohë kur shkelja e pretenduar ka ndodhur;
sjelljen e magjistratit që, nëse provohet se është kryer, përbën shkelje disiplinore të parashikuar nga ligji.

Vetëm pasi plotësohen të gjitha këto kushte, ankesa pranohet dhe vijohet me procedurat e verifikimit të pretendimeve të ngritura në ankesë. Nëse njëri ose më shumë kritere nuk plotësohet, atëherë Inspektori i Lartë i Drejtësisë nxjerr vendimin për arkivimin e ankesës. Ju do të njoftoheni për vendimin e arkivimit të ankesës dhe për të drejtën tuaj për t’u ankuar, ku mund të ankoheni ndaj vendimit bashkë me afatin brenda të cilit mund të ankoheni.
