HPC PARTIALLY ACCEPTS THE REQUEST OF THE HIJ FOR DISCIPLINARY MEASURE AGAINST MAGISTRATE K.LL.

In today’s session, the High Prosecutorial Council partially accepted the request of the High Inspector of Justice related to the disciplinary proceeding against magistrate K.Ll., who is a prosecutor at the Prosecution Office at the Court of First Instance of General Jurisdiction Saranda, imposing him the measure “Public reprimand”.

The disciplinary investigation of the HIJ against the magistrate has been initiated based on the complaint of a citizen, submitted through the online form on the HIJ website, with the claim of delaying the investigation of the criminal proceeding by prosecutor K.Ll.

The disciplinary investigation concluded that actions and lack of actions by prosecutor K. Ll., relate to unjustified failure to fulfill his duties during the investigation, resulting in unjustified delays in procedural acts, which are mandatory for implementation by magistrates; the prosecutor’s omissions were committed with direct intentional fault, by not fulfilling the duties assigned by the courts, taking no action regarding the investigative file without action for a period of over 2 years.

The HIJ investigative report notes that as a result of the disciplinary violation committed by the magistrate subject to the disciplinary investigation, the prestige of the prosecutor image has been damaged, as well as the public’s trust in justice has been damaged, while this inappropriate behavior may lay ground for other similar cases.

Taking into account that the magistrate has no disciplinary measure and has not committed any other disciplinary violation, HIJ proposed to the HPC to impose the disciplinary measure “Temporary salary reduction” of 40% for a period of one year against prosecutor K.Ll., provided for by article 105, point 1, letter “c” and article 108 of the law “On the status of judges and prosecutors in the Republic of Albania”, a request that was partially accepted by the High Prosecutorial Council, which decided to impose the measure “Public reprimand” for prosecutor K.Ll.
